Company has third-party installers, installers causes damage to customers property, whose to blame?
Bernies Design has a team furniture installers in Chicago, but for installations in other parts of the country, contracts with local installers of others. These third-party installers business owners, but have signed a contract with Bernie that governs the relationship between the parties. These employees do not wear uniforms Bernies. A situation has arisen with Terry Installers of furniture, a furniture manufacturer to install third party with whom Alston often Bernies contracts for facilities in Minneapolis, Minnesota. During installation cubicles in the office of the client, one of the installers inadvertently broke a network cable. The client employees were unable to work for a day and a half until the cable could be replaced damages. The customer wants to pay Bernie and Terry. Whose fault.
All of them are responsible for the damages and the employer may be responsible for some of the costs if the installation program reported the location of the cable. ~
